Terms of Service

These Terms of Service ("Terms") govern your use of Tusk ("the Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you are authorized to act on behalf of any organization whose data you submit.

No Legal or Regulatory Advice

Tusk is a tracking and reminder tool only. It records dates, documents, and requirements that your own team enters — it does not determine, verify, or guarantee what any specific law, regulation, fire code, insurance requirement, or permitting rule actually requires in any given city, county, or state.

Compliance requirements vary by jurisdiction and change over time. You (and your organization) are solely responsible for determining what actually applies to your properties and for verifying the accuracy of any dates, cycles, or requirements you enter into Tusk.

Tusk does not provide legal, regulatory, or insurance advice, and using Tusk does not guarantee compliance with any law or regulation. For authoritative guidance specific to your properties and jurisdiction, consult a licensed attorney, insurance professional, or the relevant regulatory authority.

The Service

Tusk is a compliance and renewal tracking platform for property management teams. It helps you monitor expiration dates, receive automated reminders, and maintain records across your property portfolio. Tusk does not itself manage maintenance work orders, tenant relationships, rent collection, or accounting — it is a compliance and renewal tracking tool only.

Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate information when creating your account.
• You are responsible for all activity that occurs under your account.
• You must be authorized to act on behalf of any organization whose data you submit.
• If you register on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Subscriptions, Free Trial, and Billing

• Tusk offers a 14-day free trial. A valid payment method is required to start a trial. Your payment method will not be charged during the trial period.
• Unless you cancel before your trial ends, your subscription will automatically convert to a paid plan at the then-current price for your selected billing interval (monthly or yearly), and your payment method will be charged automatically at the start of each billing period thereafter.
• Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You can cancel at any time from the billing management portal accessible through Settings; cancellation takes effect at the end of the current billing period, and you will retain access through that date.
• Fees are billed in advance and are non-refundable except where required by law. We do not provide prorated refunds for partial billing periods.
• We may change our pricing from time to time. If we change the price of your plan, we will provide reasonable advance notice before the change takes effect on your next renewal; continuing to use the Service after a price change takes effect constitutes acceptance of the new price.
• If a payment fails, we may retry the charge and may suspend access to certain features until payment is resolved, consistent with how the Service's billing status is displayed to you within the app.
• All payments are processed by Creem, our third-party payment processor and merchant of record. Tusk does not collect or store your full payment card details.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Upload content that infringes the intellectual property rights of others.
• Attempt to access data you are not authorized to view.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to circumvent any access controls, subscription limitations, or security measures of the Service.
• Use the Service to store or transmit unlawful, defamatory, or infringing content.

Your Content and License to Tusk

You retain ownership of the property, compliance, and other data and documents you submit to the Service ("Your Content"). You grant Tusk a limited license to host, store, process, and display Your Content solely as necessary to provide the Service to you. This license ends when Your Content is deleted from the Service, except for residual copies that may exist temporarily in backups, consistent with the retention practices described in our Privacy Policy. You are solely responsible for Your Content and for ensuring you have the right to submit it, including any personal information about third parties it may contain.

Third-Party Services

The Service relies on third-party providers to operate, including Base44 (application hosting, database, authentication, file storage, and email delivery) and Creem (payment processing). Your use of the Service is also subject to the applicable terms of these providers where relevant to the services they provide.

Intellectual Property

The Service, including its design, branding, and software, is owned by Tusk and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding.

Reminders and Notifications

The Service sends automated reminders based on expiration dates and thresholds. While we strive for reliability, we are not liable for missed reminders caused by incorrect data entry, changed email addresses, or circumstances outside our control. You are responsible for keeping your records and contact information current.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or that reminders will always be delivered.

The Service is not a substitute for professional legal, regulatory, insurance, or compliance advice, as described above.

Limitation of Liability

To the maximum extent permitted by law, Tusk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including any lapse in compliance or regulatory penalties resulting from missed reminders. To the maximum extent permitted by law, Tusk's total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Tusk in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold Tusk harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

Termination

You may delete your account at any time from the Settings page. We may suspend or terminate access if you violate these Terms, fail to pay applicable fees, or if we reasonably believe the Service is being misused. Upon termination, your right to use the Service ends immediately; data handling upon termination or account deletion is described in our Privacy Policy.

General

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tusk regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• Assignment: You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets, consistent with the Business Transfers section of our Privacy Policy.
• No Waiver: Our failure to enforce any provision of these Terms is not a waiver of that provision.
• Force Majeure: We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control.

Changes to These Terms

We may update these Terms from time to time. We will indicate the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
